Quick answer

Self-employed activity is classified as freiberuflich or gewerblich based on what you actually do—not the English label “freelancer.” Check residence permission first; then classification determines registration, trade tax and chamber implications.

Important

Business classification, permits, tax and social-insurance outcomes depend on the actual activity and personal circumstances. This is general information, not legal, tax, immigration or business advice. Confirm decisions with the responsible authority or qualified adviser.

1. Freiberufler versus Gewerbe

Qualifying liberal professions register through the Finanzamt and generally do not make a Gewerbeanmeldung or pay Gewerbesteuer. A commercial/trade activity normally registers with the municipality and can trigger chamber and trade-tax duties. The Finanzamt decides tax classification from the substance.

2. Job titles do not decide classification

Certain doctors, lawyers, architects, journalists, translators, engineers, teachers, scientists and artists may qualify depending on education and actual work. A developer, designer, consultant or IT contractor is not automatically Freiberufler.

Example

IT contractor

Investigate the exact service, qualification, independence, client relationship, residence permission, VAT and insurance. Do not self-classify from the job title.

Trading goods is likely to lead toward Gewerbe registration, but permits and tax treatment still depend on the activity.

3. Residence permission comes before registration

A non-EU Aufenthaltstitel or Zusatzblatt may permit, restrict, require approval for or exclude self-employment. Gewerbeanmeldung does not create immigration permission. Read the exact wording and ask the Ausländerbehörde where unclear.

Registration is not permission

Do not start invoicing merely because a Gewerbeamt accepts a form. Immigration authorisation is separate.

4. Side business and Nebengewerbe

Employees should check contract notification, competition, confidentiality and working-time issues. An employer cannot simply prohibit every lawful side activity, but legitimate conflicts, performance and time limits matter.

Side profit belongs in tax reporting and can affect health insurance or residence status. Nebengewerbe describes scale/timing; it is not a separate tax-free legal form.

Example

Check the employment contract, residence wording, classification, working time, VAT, health insurer and whether the client setup resembles employment.

5. Health insurance and pension

Health insurance remains compulsory. Depending on the facts, voluntary GKV or PKV may be available; neither is universally cheaper. Tell the insurer about expected profit and working pattern.

Some self-employed professions and dependency patterns are subject to statutory pension insurance while others are not. Never assume self-employed means “no pension contributions”; ask Deutsche Rentenversicherung.

6. False self-employment (Scheinselbstständigkeit)

Invoices and a Gewerbeschein do not prove genuine self-employment. Assessment looks at the real relationship: integration into the client organisation, instructions/control, entrepreneurial risk and whether the work functions like employment. There is no reliable one-factor or points test.

The DRV status-determination procedure can clarify status. This is especially important for long-term single-client contracting.
